Please read these Terms of Service completely on using www.Pet911.co.za. This Agreement documents the legally binding terms and conditions attached to the use of the Site at www.Pet911.co.za.

By using or accessing the Site in any way, viewing or browsing the Site, or adding your own content to the Site, you are agreeing to be bound by these Terms of Service. You also agree to our privacy policy and any other policies we post on Pet911.

Intellectual Property
The Site and all of its original content are the sole property of Pet911.co.za and are, as such, fully protected by the appropriate international copyright and other intellectual property rights laws.

You may view, download for caching purposes only, and print pages from the website for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions.

Termination
Pet911.co.za reserves the right to terminate your access to the Site, without any advance notice.

Publishing of Content
You hereby acknowledge and agree that you are solely responsible for all materials that you approve for publishing, display, and distribution by us in connection with the Services, or that you post, publish or distribute in connection with the Services, including without limitation, advertisements prepared by us for you (including all information, trademarks, and photographs contained in such advertisements), information, data, text, software, links, photographs, pictures, graphics, video, messages, files and any other materials (“User Content”). You represent, warrant and agree that no User Content that you approve for publishing, display, and distribution by us, or submitted by you or through your account, will: violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; contain defamatory material; or violate or encourage violation of any applicable, laws, regulations, rules, professional codes, codes of ethics, administrative laws, codes of conduct or standards (including, without limitation, rules, standards or codes of conduct for non-governmental or quasi-governmental associations), e.g., federal, state, or local laws, regulations, rules, professional codes, codes of ethics, or administrative laws.

For the purpose of clarity, by paying us to publish and distribute an advertisement prepared by us for you, you are approving the publishing of such advertisement by us on your behalf. You represent and warrant that you have all legal rights necessary to publish and distribute (or necessary to have us publish and distribute) any User Content or that you own such User Content. You represent and warrant that the advertisement prepared by us for you will comply with all applicable laws, rules, and regulations.

Posting Guidelines
In the event of a violation of any of the following guidelines, we reserve the right to remove content or ban users from Pet911.co.za (e.g. Facebook or Instagram pages).

Posting Guidelines:

  • Pet911 does not take part in foster care or custody disputes. If you believe someone has wrongful custody of a pet, Pet911 is not the place to resolve that dispute.
  • Pet911 is a platform for LOST and FOUND pets ONLY.
  • Please do not include personally identifiable information about other individuals in your posting.
  • Please do not use profanity.
  • Only images of your pet or a pet you found should be submitted. Please do not submit images of anything else.
  • Please do not post the same pet more than one time.
  • Please do not include links to other sites in the post message.

Service Fees

Certain parts of the Site may be accessed and used without charge. For use of certain Services, you are required to pay applicable fees which may change from time to time subject only to your right to terminate such Services in accordance with the terms thereof. Fees vary by Service. Current fee schedules are available on the Site. You are responsible for payment of all applicable fees incurred by your Site account. All fees due from you to us are referred to herein as “Service Fees”. A full breakdown of applicable Service Fees is available upon request, including advertising/service fees spent through social media (e.g. Facebook or Instagram).

You agree that we may charge all Service Fees to the payment method you have provided in your Registration Information. You are responsible for the timely payment of all Service Fees at the time the Services are ordered by you. It is your responsibility to notify us if your payment method has changed by making the appropriate changes to your account settings. If you do not provide a valid payment method, or if your designated payment method is determined by us to be inactive for any reason, we may immediately discontinue providing Services to you.

Refund Policy
All refund requests must come from the email used to create the account under which the premium service was purchased.

Due to the urgent nature and costs incurred immediately at the time of purchase to deliver our premium services, we cannot guarantee refunds outside of the limited situations listed below:

Product malfunction. In the case of a product malfunction, a refund may be requested by sending an email to [email protected]. Examples of product malfunctions include: the ad campaign did not run at all, the ad campaign targeted the wrong area. If the product malfunction is verified by a member of the Pet911 Support team, a refund will be provided.

Billing error. In the case of a billing error (e.g. a duplicate charge), a refund may be requested by sending an email to [email protected]. If the billing error is verified by a member of the Pet911 Support team, a refund will be provided.

Indemnity
You hereby indemnify Pet911 and undertake to keep Pet911 indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by Pet911 to a third party in settlement of a claim or dispute on the advice of Pet911’s legal advisers) incurred or suffered by Pet911 arising out of any breach by you of any provision of these terms and conditions.

Breaches of these terms and conditions
Without prejudice to Pet911's other rights under these terms and conditions, if you breach these terms and conditions in any way, Pet911 may take such action as Pet911 deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

Disputes
If the Customer disputes any Services supplied by Pet911 the Customer must notify their reasons in writing to Pet911 within 14 days of the Invoice date, failing which the Customer loses any right to dispute the quality of the Services or value.

Variation
Pet911 may revise these terms and conditions from time-to-time. Revised terms and conditions will apply to the use of this website from the date of the publication of the revised terms and conditions on this website. Please check this page regularly to ensure you are familiar with the current version.

Assignment
Pet911 may transfer, sub-contract or otherwise deal with Pet911's rights and/or obligations under these terms and conditions without notifying you or obtaining your consent.

You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

General provisions
Pet alerts are used soley for notifying the general public about lost or found pets. By sending a pet alert you agree that you are responsible for it's content.

We may use the information you provide to inform other members or the general public about theft hot spots or other information pertaining to the welfare of pets.

It is your responsibility to keep your listing updated. We reserve the right to contact you to follow up on unresolved listings and may remove listings if contact can not be made.

Pet911 is not liable for any rewards offered.

Unsubscribing may remove any and all pet listings and contact information.

Disclaimer of Warranties
We are not responsible for any incorrect or inaccurate content published on the Site or in connection with the Services, including User Content published by users (or published by us on behalf of users) of the Site or the Services. We are not responsible for the conduct, whether online or offline, of any user of the Site. The Site and the Services may be temporarily unavailable from time to time for maintenance or other reasons. We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, the Site or the Services. We are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment or software, or the failure of email on account of technical problems or traffic congestion on the Internet or at any web site, including injury or damage to any person’s computer related to or resulting from participating or downloading materials in connection with the Site or the Services. Under no circumstances will we be responsible for any loss or damage, including personal injury or death, resulting from anyone’s use of the Services, the Site or any content published on the Site (whether or not Site Content, User Content, or other content).

WE ARE NOT RESPONSIBLE FOR ENSURING THAT USER CONTENT PUBLISHED BY USERS (OR PUBLISHED BY US ON BEHALF OF USERS) OF THE SITE OR THE SERVICES COMPLIES WITH APPLICABLE ADVERTISING LAWS, RULES OR REGULATIONS, AND WE OFFER NO WARRANTY THAT ANY SUCH USER CONTENT SHALL COMPLY WITH APPLICABLE ADVERTISING LAWS, RULES OR REGULATIONS. WE SHALL HAVE NO LIABILITY OF ANY NATURE WHATSOEVER FOR YOUR COMPLIANCE WITH OR BREACH OF ANY APPLICABLE ADVERTISING LAWS, RULES OR REGULATIONS.

WE OFFER YOU NO GUARANTEE OF PHYSICALLY LOCATING YOUR LOST PET AS A RESULT OF THE DISPLAY OF ADVERTISEMENTS PREPARED BY US FOR YOU.

Severability
If a provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect.

Changes to Terms and Conditions
Pet911 reserves the right to make amendments to the terms and conditions from time to time. Therefore, we ask that you check and review this Agreement for such changes on an occasional basis. Should you not agree to any provision of this Agreement or any changes we make to this Agreement, we ask and advise that you do not use or continue to access the Pet911.org site immediately.
